This notice, in compliance with the Personal Data Protection Act 2010, clarifies the rights, interests, obligations and duties of all parties from the point of collection, recording, holding, storing or processing of your personal information and data by HHIM in the commercial transactions to safeguard your interests and to ensure your Personal Data is well protected.

Personal Data means any information, whether recorded in a materials form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.

In the course of your dealings with HHIM as our customer and participant in any programs organized by us (if any), you may be asked to provide data and information about yourself (“Personal Data”) to enable us to enter into a transaction with you or to deliver the necessary notices, services and/or products in connection with our line of business.

3. You warrant and represent to HHIM that the Personal Data disclosed to HHIM is accurate and complete. NATURE OF PERSONAL DATA

1. The nature of Personal Data we collect from you may include the following Personal Data:

   1. Name, NRIC Number, Nationality, Passport Number, Gender, Date of Birth, marital status, Home Address, Office Address, Email Address, contact number, occupation, photographs and videos;

   2. Bank Account details and credit card details.

   3. Name and particulars of spouse.

SOURCE OF PERSONAL DATA COLLECTION

1. Your Personal Data will be collected directly from you when you:

   1. create an account with us at our website, www.healthyharvest2u.com (“website”);

   2. apply for any of our services or purchase any products available on our website

   3. enter a competition, promotion or survey organized by us;

2. The provision of Personal Data is voluntary. Unless otherwise stated, all Personal Data requested by HHIM, is obligatory and shall be provided by you. 2. HHIM reserves the right not to entertain any request for withdrawal of consent, access or correction of any Personal Data in the following circumstances:-

   1. where insufficient information has been provided by you or any party making a request to enable HHIM to positively locate and identify the Personal Data in question;

   2. where there is reasonable doubt surrounding your identity or the identity of the person making the request or where HHIM feels that you or the requesting party is not in fact the owner or the subject of the Personal Data in question and is not lawfully entitled to make any requests in relation to the Personal Data;

EXCLUSION OF LIABILITYS

1. Notwithstanding the above, HHIM shall not be held liable for any purported violation, breach or non-compliance with any precepts of privacy or the protection of Personal Data in the following circumstances:-

   1. where an act of nature or event outside the control of HHIM results in the damage or malfunction or destruction in any equipment or machinery used to secure, store or process Personal Data;

   2. where the Personal Data is readily available or able to be found in public domain;

   3. where despite HHIM’s best efforts, there is unauthorised access, modification, alteration, misuse, tampering or abuse of Personal Data caused by the malicious or fraudulent or criminal acts or conduct of a third party not being under the control or direction of HHIM.

NOTICES

1. All notifications or other communications from you to HHIM must be made in writing, legible and contain your full name, address, NRIC number and contact details. HHIM reserves the right not to respond to any notices or communications which do not contain the foregoing particulars, are illegible, incomprehensible or where the party concerned cannot be contacted or where the contact particulars are found to be incomplete, inaccurate or in error.
